In ‘The Terminator’, Simon Tolson will discuss the latest case law, developments, and legal issues surrounding the termination of construction contracts.

Termination is a powerful and definitive device that discharges all unperformed primary obligations under the contract yet to accrue and ends the contractual relationship, often instantaneously.

Profound commercial and financial consequences for the parties can ensue. This can be acute for the defaulting party. Not only are they deprived of the benefit of the contract; in many cases they must also compensate the injured party in damages. But, equally, getting it wrong can also be very dangerous for the ‘innocent’ party.

There have been a number of important decisions in the courts since 2022, the implications of which will be examined by Simon in more detail. Simon’s presentation will be essential viewing not just for JCT contract users but all those involved in the contractual process within the construction industry.

Karen Kirkham is a construction lawyer at BDB Pitmans LLP. She has 30 years’ experience working with JCT contracts, advising clients from all sectors of the industry. Her clients include commercial developers, occupiers, charities, local authorities, public infrastructure companies, contractors, sub-contractors, architects, and individual householders. Karen has been listed as a leading construction legal practitioner in Chambers since 2008 and regularly publishes articles on topical construction issues.

Karen’s involvement and interest in JCT goes back a long way. She is a former legal director of the Construction Confederation during a key period for the industry when major legislation, including the Housing Grants, Construction and Regeneration Act 1996 and Arbitration Act 1996, was being passed.

Simon Tolson is a senior partner at Fenwick Elliott LLP, and a solicitor, chartered arbitrator and adjudicator. He has specialised in construction and energy dispute law for over 35 years on a huge range of project types and infrastructure developments in the UK and overseas. During his career he has led over 20 reported cases in the courts.

Simon is ranked amongst the top construction solicitors in Who’s Who Legal, Chambers UK, The Legal 500 UK (Hall of Fame) and the Legal Experts guides. He takes a keen interest in building defects cases, the Building Safety Act, and related areas, and has lectured widely and appeared in many webinars.
Simon currently holds the TECSA Clare Edwards Award for 2023, awarded to an individual demonstrating professional excellence and for making an outstanding contribution to the legal profession.

Can I attend the event in person?

No, the event will be solely delivered over a live stream. We hope that by hosting the event this way it is open to viewers that wouldn’t normally be able to attend the physical event due to geography and their work location.

Will I receive an email confirming my registration?

Yes, once you have registered, you will receive confirmation that your place has been secured, plus other information about the event such as the live stream URL and testing instructions.

How can I ask questions for the Q&A session?

There will be a text interface under the video stream in which you can ask questions at any point during the main lecture.

Do I need to set a password ?

No, you don’t. Once you have registered, you’ll be sent an email containing the website URL to click and access on the day of the lecture.

Can I test my device/connection before the day of the event?

Yes, you can and we strongly recommend this for ALL users. There will be very limited technical assistance available on the day of the event. Two weeks before the live broadcast, we will send out a test link to all register users and will provide technical assistance to resolve any issues with viewing the test video.

What link do I need to see the live stream on the day?
